am writing to raise an URGENT safeguarding and human rights concern regarding Ellie Louise Horstead (DOB 25/03/2005), who is currently placed at Hill Tops, West End Road, Burrsleden, Southampton.
Now they wont to move ellie out of southampton with no family .
As set out in the attached letter, Ellie is currently subject to a Section 31 Care Order and a Deprivation of Liberty authorisation. However, there are significant concerns that:
• Ellie has mental capacity, yet remains deprived of her liberty
• She has been isolated from her mother and family, causing distress and harm
• The current arrangements may amount to unlawful deprivation of liberty and false imprisonment
• Her rights under Articles 5 and 8 of the Human Rights Act, and Articles 5, 9 and 12 of the Universal Declaration of Human Rights, are at risk
Given the seriousness of these concerns, I am formally requesting:
1. An immediate safeguarding investigation
2. An urgent review of Ellie’s mental capacity assessments
3. Confirmation of the legal basis for the current Deprivation of Liberty
5. Immediate steps to address family contact and isolation concerns
This matter is urgent and involves potential ongoing unlawful detention and human rights breaches.
